Trust for foreign 

First of all, it is important that we keep in mind that as foreigners in Mexico, if we want to invest in the purchase of a property, be it land, house, apartment, commercial premises or any other real estate, we are going to need to establish a TRUST, which is not more than a permit granted by the Mexican Ministry of Foreign Relations, in order to allow the use and exploitation of real estate located in a restricted area, in favor of foreign persons (physical or legal) or to Mexican companies with an admission clause of foreigners, as long as the real estate is intended for residential purposes, for a maximum period of 50 years.

This restricted zone corresponds to 100 km along the borders and 50 km along the beaches (federal maritime-terrestrial zones).

The constitution of a Trust is carried out by the trust entities of the credit institutions (banks). Likewise, the trusts must be recorded in a public deed.

REQUIREMENTS:

1. Name and nationality of the settlor.

2. Name of the credit institution (bank) that will be the trustee.

3. Name and nationality of the trustee, and if any, of the second trustees and substitute trustees.

4. Duration of the trust

5. Use to be given to the property

6. Description, location, measurements, boundaries and total area of ​​the property that is the object of the trust.

7. Distance of the property from the border or the maritime zone.

8. Cover the payment of rights of the SRE established in article 25 of the Federal Law of Rights in force, in a bank.

9. Submit the permit application only by electronic means. (This procedure can be carried out by law firms or directly by the fiduciary entity where you are processing your application, with a bank advisor).
